JUSTICE FOR THE RULE OF LAW IN THE JUDICIAL SYSTEM

22nd September 2023

UPDATED: Tribunal affirms Plateau State Governor's election

JUSTICE FOR THE RULE OF LAW IN THE JUDICIAL SYSTEM:

I have been telling those who think that the judicial system in Nigeria is bent for unjustified favoritism, like in the previous Administration, where Nigerians recorded a high rate of Anarchist's system of Government, who extremely exercised absolute powers over the detriment of the people. As the saying, "absolute power corrupts absolutely. And he who seek for Justice must come with clean hands"✋

It is quite unfortunate for the All Progressive Congress APC on the Plateau, that it is no more business as usual. And so, they are left to learn how to embrace democracy; and not an autocratic system.

More also, the virdict passed by the Supreme Court of Justice, justified the validity of the PDP structure on the Plateau; and the Tribunal rulling and declaration of His Excellency Barr. Caleb Mutfwang, as the substatancial Executive Governor of Plateau State, shows that democracy has come to stay according to the rule of Law and scale of Justice⚖️.

CONGRATULATIONS!
To the PDP structures in Plateau State and His Excellency Barr. Caleb Manaseh Mutfwang.

DOES PDP IN PLATEAU STATE NEED TO PANIC?
According to the article by Emmanuel Menseh Madaki Esq.
The Peoples Democratic Party in the state need not panic or be distracted by the ruling APC for the following reasons:

* The party is in a good footing and standing in law and conduct and has so far not violated any known law anywhere.
* The party endeavored to comply with the express orders of Hon. Justice S. P. Gang and Hon. Justice I.I. Kunda respectively.
* What the party sought to achieve by the suit that journeyed up to the supreme court had been laid to rest with the compliance with the judgments of the courts below and that has nothing to do with the present candidates that emerged in the just concluded general elections. So, there was no need pursuing the case at the supreme court.
* The suit at the Supreme Court was already academic before its dismissal and existence of the party as at today has no defect whatsoever see CA/J/300/2023 Between Augustine Timkuk vs INEC & Ors decided in 2023.
* The scenario that led to APC losing seats in Zamfara in 2019 is radically different from the PDP Plateau scenario whereas that of Zamfara was purely a pre-election party dispute involving members of the party, there is no dispute between the members of PDP in Plateau State anywhere before the emergence of the candidates of PDP that contested the 2023 general and even after the election.
* Assuming but not conceding that there is a crisis rocking the PDP in the state who has the locus standi in law to raise that issue? Is a pre-election matter or an issue for the tribunal? What is even more interesting is the fact that the supreme recently held in UFOMBA v. INEC & ORS (2017) LPELR-42079(SC) that: “the law is trite that Courts’ jurisdiction is ousted in matters dealing with internal affairs or resolution of a political party regarding nomination or leadership of that political party as in this instant case.” Pp 47, paras A-B
* The APC in Plateau State is simply dancing naked and or nude in an open market by deploying all efforts to invalidate, intimidate, scare and or present a hopeless scenario for the PDP candidates that won the 2023 general elections instead of focusing on the defeat and allow the tribunal to do its job, since the APC candidate vowed to challenge the outcome of the election in court.

*CONCLUSION*
There is no law or legal burden placed on the PDP in the state which it is yet to discharge or in violation.
Let the celebration continue as the PDP suffers no defect in law and all the candidates are proper in law.

And according to the article by James Abraham of the Punch news papers

A three-member panel of the tribunal led by Justice Sunday dismissed the petition filed by the All Progressives Congress and it’s Governorship candidate, Nentawe Yiltwatda delivered the judgment on Friday morning.

The Independent National Electoral Commission declared Mutwang of the Peoples Democratic Party the winner of the March 18 governorship election with 525,299 beating 17 other candidates including Yiltwatda who polled 481,370.

Yiltwatda and his party, APC, had approached the tribunal to disqualify Mutfwang and declare him the winner of the election, while claiming to have polled the highest valid votes cast.

The petitioners insisted that Mutwang was not validly nominated by his party to stand for election as his party lacked the structure to do so

The petitioners equally challenged the victory of the PDP governor over an alleged over-voting in the scores recorded for him by INEC

However, delivering the judgment, the tribunal held that Yiltwatda and his party failed to prove their case.

The tribunal held that the PDP conducted a repeat congress in 2021 and therefore, had a solid structure as a party to nominate candidates for elections.

The tribunal equally rejected Yiltwatda and his party’s witnesses that Bimodal voter accreditation system was not used noting that the total number of votes cast was four out of four voters and as such the tribunal found that there was no case over-vThe witness admitted that he was not in PDP but had an agent that gave him information about the PDP primaries that the party did not have structure.

“Witness confirmed under cross examination that he is not a member of PDP, but that whatever happens in the PDP is in public domain.

“The tribunal is of the view that the pdp conducted a repeat Congress in 2021.

“What is admitted needs no further proof. The APC has admitted in its petition that the PDP repeated its congress.

“The APC in its witness cross examination admitted that the PDP complied with the court order and repeated its congress

“The petitioners presented a witness who admitted she was a polling unit agent, but admitted under cross examination in the case of Jos North that the signature on the polling unit result is not her’s. The evidence is thereby expunged by the tribunal.

“Another witness admitted that BVAS was not used but that the total number of votes cast is four out of four voters. The tribunal has thereby found that there is no over-voting”,the tribunal ruled.

The PUNCH reports that the tribunal had earlier dismissed the petition filed by the NNPP candidate against the election of Mutfwang for lack of merit.

Published by
Comr. David Mancha
13 July 2023

Plateau State Governor, Barr. Caleb Manasseh Mutfwang, has visited the Chief of Defence Staff, Major General Christopher Musa and the Chief of Army Staff, Major General, Taoreed Lagbaja and solicited for swift intervention to arrest the deteriorating security situation in Mangu, Barkin-Ladi, Riyom and other Local Government Areas of the State.

Governor Mutfwang, whose first point of call was the Defence Headquarters,  congratulated the Chief of Defence Staff on his appointment by the President and expressed hope that he would bring to bear his wealth of experience in tackling the security  challenges confronting Plateau State and Nigeria as a whole.

He said, "We are here on behalf of the government and peace-loving people of Plateau State to congratulate the Chief of Defence Staff on his well-deserved appointment and to also appraise the security  situation on the Plateau.

"Knowing how professional he is, we are optimistic that he would bring his wealth of experience  to bear in dealing with the situation on the Plateau so that we can have early resolution of the bad situation on ground.

"We declared a curfew some days back to arrest the deteriorating situation and we are glad that the General Officer Commanding 3rd Division has moved his operational base to Mangu Local Government.

"I am glad to inform you that the situation is calming down. The curfew  is being reviewed on daily basis and I am sure that before long, we will lift it up entirely."

The Chief of Defence Staff, Maj.-Gen. Christopher Musa, who warmly welcomed the Governor, expressed sadness  over the deteriorating  security situation  and said that everything  possible  would be done to bring the situation  under control.

He urged Plateau people to remain peaceful and law abiding, saying that they are working round the clock to discharge  their constitutional  responsibility of protecting  the territorial territory of Nigeria.

He said, "The GOC has moved his operational ground to Mangu Local Government Area and Plateau is known as "Home of Peace and Tourism"; we will do everything  to achieve peace and tranquility  in Plateau State.

Governor Mutfwang, while at the Army Headquarters, also congratulated the Chief of Army Staff, Maj.-Gen. Taoreed Lagbaja, on his well-deserved appointment and solicited  his collaboration in protecting  lives and property in the State.

GOVERNOR MUTFWANG SOLICITS NEMA'S SUPPORT FOR PLATEAU IDPS, REITERATES COMMITMENT TO ENDING INCESSANT ATTACKS

The Executive Governor of Plateau State, His Excellency, Barr. Caleb Manasseh Mutfwang has solicited for more support from National Emergency Management Agency (NEMA) for Internally Displaced Persons (IDPs),  who suffered from the incessant attacks in Mangu Local Government Area of the State.

Governor Mutfwang  made the call on Wednesday during a visit to the Headquarters of National Emergency  Management Agency (NEMA), Abuja where he applauded the Agency  for its swift intervention whenever the state was engulfed in humanitarian crisis.

"Before I even came into office, I know that NEMA has always extended its goodwill to us when there was a storm in Mangu. We received that package and our people were very happy. Also, with the recent development that bothers on insecurity, we also received the goodwill of NEMA and it has gone a long way in addressing  some of the fall out of the security challenges.

"At the last count, we had IDPs in about 13 different  locations and it is unfortunate. Part of this visit is to brief Heads of Security Agencies on the true situation on the Plateau and to harvest  their goodwill to ensuring that this challenge is brought to an end.

"Plateau is a multi-lingual state, is a multi-religious state and we have always lived in peace with one another but in the last two to three months, there is a dimension in which it has taken. There are places which hitherto were quite peaceful and one of the places is my own Local Government Area Mangu. Before now, it was one of the most safest places but now, it has come under serious siege.

"As Government, we are doing everything to reassure the people that we can still live together but some vested interests find a way of bringing  in mercenaries from outside who have attacked those communities. Their houses have been destroyed and their properties vandalized.

"Few of the communities which have managed to still farm, these insurgents come in the night and cut the maize which has already grown and if you can farm in Mangu for example, it makes a significant contribution to food security in Nigeria and this year, there will be reduction in food production."

He appealed to NEMA to come to the aid of the innocent communities that have been made to go through this unfortunate humanitarian crisis.

Governor Mutfwang  reassured Plateau people of government's  commitment towards addressing the vicious attacks on innocent communities in the state.

The Dorector General, National Emergency Management Agency (NEMA), Mustapha Habib Ahmed thanked the Governor for the visit  and assured that the Agency will do everything  possible to assist the victims.

He expressed appreciation to Governor Mutfwang  for donating a befitting office for the smooth operations of the Agency and said that will aid their on-the- spot assessment of the current situation for swift intervention.

Government Caleb Mutfwang at Sallah celebration

GOVERNOR MUTFWANG RECEIVES MUSLIM UMMAH ON SALLAH HOMAGE,  CALLS FOR PEACEFUL CO-EXISTENCE

The Executive Governor of Plateau State, His Excellency, Barr. Caleb Manasseh Mutfwang has assured the Muslim community in the State of his administration's willingness to provide a leadership that will embrace everybody irrespective of ethnicity, faith and place of residence.

Governor Mutfwang stated  this on Sunday when the Muslim Ummah in Plateau State led by the Emir of Wase, Alh. Mohammed Sambo II and Chairman, Jama'atu Nasir Islam (JNI) paid him the traditional Sallah homage at Old Government House, Jos.

The Governor said it is time for both Christians and Muslims in the State to find a common ground in order to foster peace and unity for the sake of development and progress of Plateau State.

He urged the Muslim Community to disregard all the misleading information being peddled around by enemies  of progress that he will send out Muslims who are resident in the state.

Governor Mutfwang solicited the support of the Muslim community to his administration in its determination  to build a new Plateau  where Muslims would be able to embrace Christians in their communities while Christians can also protect and preserve Muslims in their communities.

He explained that throughout his life, he has maintained very cordial and mutual relationships with his friends who are both Muslims and Christians and urged people to channel their energy towards what will prosper the state and not divide it.

Governor Mutfwang appreciated the 14th Emir of Kano, Alh. Sanusi Lamido Sanusi, who was in the state for condolences but joined the Muslim Community for the  Eid-El-Kabir visit, and described him as a great asset to Nigeria.

The 14th Emir of Kano, Alh. Sanusi Lamido Sanusi who was in Plateau for a condolence visit said it is time for both Muslims and Christians to work out a framework for peace and unity in not only Plateau State but Nigeria as a whole.

"The Niggeria in which we grew up was the one in which this ethnic and religious identity conflict were nonexistent. The best way for us to have inclusiveness is for us to think about everybody in terms of humanity.

"We have good and bad people; we have kind  and wicked people; we have honest and dishonest people; and we need to identify and work with each other on the basis of shared values. The values of peace, the values of good neighborliness, the values of beliefs and each other personality and Jos used to be the centre of this in Nigeria," he stated.

The Emir of Kanam, Alh. Mohammed Mu'azu Muhammadu II, who spoke on behalf of the Muslim Community congratulated Governor Caleb Mutfwang on his election and inauguration  and pledged support to his administration in its efforts to bequeath enduring legacies of development in the State.

Similarly, the Emir of Wase, Alh. Mohammed Sambo II and Chairman, Jama'atu Nasir Islam (JNI) who gave the vote of thanks, prayed God to restore peace in Bassa, Riyom, Barkin-Ladi and Mangu Local Government Areas, where there has been attacks in recent times leading to the loss of lives and property.

Governor Caleb Mutfwang of Plateau State, starting on a Sound Footing

*GOVERNOR MUTFWANG, STARTING ON A SOUND FOOTING*

**By GYANG BERE*

If you want to measure the degree of animosity against any government in Plateau State, all you need to do is to wait until an election has been completed, and a new government is installed.

No matter what anyone thinks about the administration of *Governor Caleb Manasseh Mutfwang* in the last one month of its coming on board, a lot has happened for which there are many positive takeaways to run to town with.

What is more, it is in the realization of the enormous responsibilities placed on his shoulders that many citizens have asked questions on where the state should be heading to, on account of the promises made during the electioneering campaigns.

The opportunity presented for constructive criticism through citizens’ civic responsibility is to help government face the task of administration.

In more ways than one, Mutfwang’s administration has welcomed all shades of criticisms and opinions from day one. But no matter the amount of propaganda against its reputation, doing things differently has, thankfully become its middle name.

Thankfully, most have come to realization that the new administration is doing things to satisfy the generality of the citizens of Plateau State. That the Executive Governor of Plateau State, Barr Caleb Manasseh Mutfwang was prepared to go into governance amidst daunting challenges inherited from his predecessor was not lost in him; even during the electioneering days which enabled him traverse the length and breadth of Plateau.

But the depth of rot and institutional decay the state was plunged into in the last eight years was for him the task that should occupy his government, if at all he wanted to be remembered by posterity. Considering the enormous goodwill he received from Plateau people and the party to get power back from the APC, he couldn’t contemplate failure as an option.

Taking a holistic look at some of the challenges the new government met on ground in various sectors of the economy of the state, any patriotic person would read meanings into them. They appear to have been carefully programmed as booby traps set up to crush the PDP administration, whose philosophy and clear-cut vision is to champion the course of humanity and better the lot of the people.

Given the mess on ground, some pundits have even concluded that had the All Progressives Congress won the gubernatorial election on March 18, 2023, the challenges it would have met on ground on assumption of power would have overwhelmed it, the acceptance of the Peoples Democratic Party by the people is helping to change the concept of governance.

It is common knowledge that in the midst of the daunting challenges, under which any governor may lose sleep and wonder what may have hit him, Governor Caleb Manasseh Mutfwang, who kick started his administration about a month ago, firmly believe that despite the banana peels lined up for him and his party, failure wasn't on his agenda.

One of those is the inheritance of unpaid salaries running into 11 billion naira. He may not get help from the federal government as it was for the last administration where several tranches emanating from the Paris Club refund were able to upset wage bills, hence his resolve to get a loan of 15 billion naira from United Bank for Africa to pay salaries and engage in other development projects.

If the supporters of the government that had just departed thought he would easily cave in on account of the slimy but slippery grounds, all eyes were set on him, particularly the opposition APC to watch his dancing steps; and praying silently with mischief in mind to slip for obvious ridicule.

They must have felt appalled, with consternation, but more disappointed that Governor Caleb Mutfwang's take-off was a clear demonstration that he was indeed prepared and equipped with sufficient capacity for the journey that would tackle myriads of challenges inherited from the previous administration. No wonder, they have remained at the level of malevolence, plotting at each turn what could be done to ensure he became a laughing stock, while he lasted in power.

They say it is during adversity that the resolve of a leader could be tested. The political courage summoned by him to provide the needed leadership and maneuvering his way out of the slippery ground by taking off strongly; wielding enormous political will to deal with the swelling resurgence of insecurity that confronted the state weeks before his inauguration.

Many would recall that for over two decades, the state has been embroiled by recurring violent attacks, which left several lives lost and property sadly destroyed. However, the ferocity of the attacks in Mangu, Bokkos, Barkin Ladi and Riyom few days before his inauguration are enough to test his will power. He immediately sought the attention of Mr. President and the former Inspector General of Police to have their buy-in of ways to tackle the crisis for deployment of more security personnel in the trouble areas.

However, determined to make the right mark, Governor Caleb Mutfwang rightly remained focused, steady, firm and unshakable, by drawing strength from the rule of law. He was the more, divinely inspired in taking critical and tough decisions with the sole aim of returning the state on the path of recovery, growth and development. It was nonetheless his point of departure with some elements that preferred that things should be operated in the old order.

Those who have followed his activities over time are aware from the onset, Governor Mutfwang never complained nor cast aspersion on the state of dilapidated infrastructure, collapsed government institutions, widening religious and ethnic division and of broken walls of friendship inherited from his predecessor on the door steps of individuals. He took the bull by its horns by raising standards that will satisfy the hearts of the people he is now their governor.

Realizing that he needed to build those walls that have irretrievably collapsed, he channeled his energy towards healing the wounds that admissibly have been inflicted on people by believing that the land could be healed, and the people united by building bridges of friendship and confidence across all strata of the society and even beyond.

His first day in office, after the famous and well attended inauguration at the Rwang Pam Township Stadium, Jos on May 29, 2023 was heralded with prayers, to seek divine guidance and interventions to commence the journey of rebuilding Plateau on a sound footing. That symbolic start, for all intent and purposes couldn’t have been lost in a man whose relationship with God is not a matter of conjecture.

Worried by the extent of destruction on communities by marauding terrorists over the years, immediately after his inauguration, he swung into action by convening a State Security Council meeting where he was furnished with detailed security challenges and what is needed to assure people that his government cares.

To make meaning out of his engagements with security chiefs in the state, the need for closer collaboration with the existing security apparatus at the federal level, using multifaceted human approaches to secure innocent communities who are terrorized daily by bandits suspected to be herdsmen militia became manifest.

What more, to feel the pulse of the victims, the following day, Barr Mutfwang was on the road to visit all the flash points where people were attacked, maimed and killed without any reason. To get to the root of the attacks for a solution, a crack Brig-General, Gakji Shipi has been brought on board as the Security Adviser.

His first point of call was on displaced persons in Riyom and Mangu Local Government Areas whose communities were invaded by enemies of Plateau a few days before his inauguration. The Governor came with a message of hope by assuring the people that help was on the way, even as it became clear to all, who wanted to know that the killings were genocidal in nature.

The suspension of local government chairmen and councilors must be noted was based on the recommendation of the Plateau State House of Assembly. Taking a look at the new Transition Implementation Chairmen, it can be observed that they young persons imbued with fresh ideas to transform the local government areas.

The suspension was based on the inability of the local government chairmen to make available records of their income and expenditures to the House which contravened the principles of transparency, accountability and fairness to which the current administration professes and hold in high regards. This action was necessary to provide a common ground for the House to investigate activities of the chairmen within the period in office.

Certain categories of employment made in the twilight of the last administration have been suspended due largely to non-adherence to due process. Those who have come hard of this administration on the issue will soon discover when a report is made on the findings that all did not go well.

Already, some critical appointments spread across the three zones have been made to stabilize the government. It is instructive to note that all those that have been appointed are coming with fresh ideas that are capable of catapulting the administration that hit the road running from day one into prominence. In the coming days and weeks, more of such would be made, and it is possible all sectors of the state would be given fair treatment and representation.

Even when it has been reported that the governor does not intend to look back to investigate the last administration, there are some infractions made by it or its officials that will not be left unchecked. Leaving them unchecked will amount to acquiescence by his administration; a path he has sworn to avoid taking. If tough decisions have been taken to right the wrongs of the past, it is because sanity has got to be injected for once.

The reason Governor Mutfwang set up machinery in motion is for the purpose of effective service delivery, having constituted a committee headed by a retired Permanent Secretary, Nde Isaac Wadak. The committee has among other terms of reference to identify and trace all government properties that were purportedly auctioned across the country; ascertain whether or not due process was adhered to in the exercise; and recover all government assets that were purportedly /or inappropriately acquired by individuals/groups/or corporate entities.

Doing so will restore confidence in government and reclaim public assets that were illegal sold out in a mischievous manner for the purpose of self enrichment by officials and supporters in the previous administration.

Although many have interpreted the action as witch-hunt, Governor Mutfwang has his mandate clearly cut: Return Plateau from the precipice and make it great again. The Time is now to unite and make Plateau great. Together, we are greater as a people, the Time Is Now!
